What is the leave and license agreement?
A leave and license agreement is an agreement in which the licensor (i.e. the owner of the property) lets the licensee (also known as tenant) allows the licensee to occupy the premise for the duration specified in an agreement. The tenant is expected to leave the premises when the agreement period is over.

Is it mandatory to register leave and license agreement?
Yes, it is mandatory to register the Leave and License agreement. And it is advisable to register it for your own safety as well – for example – police clearance certified will not be issued to unregistered agreements.

What will happen if one doesn't register rent agreement?
The responsibility of registering the rent agreement lies with the owner of the property. If failed to do so, the owner might face imprisonment up to three months and/or a fine of up to Rs Five thousand.

If licensee does not deliver possession then what?
It is binding on the tenant to deliver the possession back to the owner as per the agreement period. If the tenant does not do it then the owner can demand double the rent amount (or a fixed charge) as damage charges.

What are the rights of licensor and licensee?
The tenant only has the right to occupy and use the property for a certain period. The tenant can not make any modifications in the property. This includes drilling or nail in the wall. The owner has a right to inspect the property during the agreement period to ensure it is in the expected condition.

How is landlord entitled to recover possession?
The tenant is expected to vacate the premises as per the duration mentioned in the agreement. Upon failing to do so, the owner can approach Competent Authority. The Competent Authority after verifying the claim, shall pass an order for eviction of the tenant.

Who can take property under leave and license?
Any person who is legally entitled to enter into a contract may take a property under lease or leave and license.

What kind of property may be taken on leave and license?
Any kind of immovable property can be taken on Leave and License for example land, flat, bungalow, shop in the mall etc.

How leave and license is different from lease?
The Leave and License allows the tenant just to occupy and use the property. It neither allows the tenant to “own” the property in the agreement period nor make any modifications nor transfer the tenancy right to another person. This is different from Leasing. The “leasing” the legal possession of the property is given to the lessee (the person/company taking the property on the lease). The lessee can sub-lease the property to another person. How are rent agreement registration charges are calculated?
Rent Agreement Registration Charges depends on Monthly Rent, Security deposit and Agreement Duration. The stamp duty is calculated on basis of these factors. Govt. Registration charges and Our service charges remains same. Govt. service/ Registration charges are Rs.1000 (One thousand Only) for Urban/Municipal area and Rs.500 (Five hundred only) for Rural areas. For furnished flats , can we add movable items like furniture in e-registered rent
agreement?
Yes. As per the current E-registration norms of leave and license system, Furniture & Fittings can be added in the agreement.

Can person having power of attorney (POA) be involved for e-registration in case the
owner is outside country?
Yes. POA holder can be the licensor of the property. The registered rent agreement will have POA’s name as the licensor and not Owners name. Call us for more details on this.

How do I renew my agreement?

If I don't want to proceed with the registration after the biometric verification then
can I get a refund?
The biometric process is done directly on the Government’s website and that is the last step of the online process. Hence, unfortunately, it is not possible to refund after the biometric verification. However, we will provide the stamp duty and registration challan details which you can use for the registration later. Please feel free to contact us if you need more information.

Is it mandatory to register rent agreement for 11 months?
It’s not mandatory to register Rent Agreement for 11 months. Renewable/extendable agreements for three to five years can also be made and registered. However, the stamp duty and registration charges for a longer duration may differ.

Total 2 witnesses are needed for Rent Agreement Registration. Both the witness should have Aadhaar and PAN number and should be available at the time of execution of the agreement.
